1. Introduction to Terms of service

1.1 These Terms of service ("Terms") govern all purchases made on www.bitcoinartwear.com or related Bitcoin Artwear platforms, including mobile applications and social media market channels (the "Website"). By placing an order, you enter an agreement with Bitcoin Artwear, operated by Hostingx ApS, organization number DK42975656, registered at Strandvej 33, 4. tv, 4220 Korsør, Denmark ("Bitcoin Artwear," "Bitcoin Artwear™," "we," "us," or "our").

2. Agreement and Order Placement

2.1 Bitcoin Artwear sells products exclusively to private consumers. By placing an order, you accept these Terms, which apply to all transactions. To make a purchase, the total amount must be at least 35 EUR, you must meet the legal age requirements, and you must have the capacity to enter into binding agreements as per applicable laws.

2.2 Once your order is placed, a confirmation email will be sent to the email address provided at checkout. This email acknowledges receipt of your order but does not constitute a binding agreement. A binding agreement is formed only when we process your order and send you a final confirmation, including a receipt.

2.3 A personal customer account is created as part of your order. By logging into your account, you can view your current orders, manage returns, and save products as favorites for future reference.

3. Pricing and Payment

3.1 Prices displayed on the Website at the time of purchase are the applicable prices for your order. All prices include VAT where relevant.

3.2 If there is an obvious error in pricing or product details, and it is reasonable to assume that you noticed or should have noticed the error, the incorrect information will not apply. We will contact you to resolve the issue or cancel the order if necessary.

3.3 Payment methods available during checkout are listed along with any associated fees (if any). Bitcoin Artwear and our payment service providers reserve the right to modify available payment options.

3.4 When paying with an international payment card, the transaction amount may be reserved immediately upon placing the order. The funds are either withdrawn (captured) when the order is dispatched (fulfilled) or released back to your account, depending on your card issuer’s policies.

4. Shipping and Delivery

4.1 Products are shipped using the delivery option selected at checkout. Information regarding shipping methods and any fees is provided on the Website and during checkout.

4.2 Delivery times listed on the Website are estimates and start from the time your order is confirmed. While we strive to meet these timelines, delays may occur due to unforeseen circumstances.

4.3 Ownership and risk transfer to you upon receipt of the products. If you authorize delivery without direct handoff (e.g., leaving the parcel at your door), risk transfers when the courier confirms delivery through GPS or photographic evidence.

4.4 Deliveries are available world wide, beside a few restricted countries which are specified here.

4.5 Larger or heavier items may incur an additional handling fee, which will be clearly displayed during the checkout process.

5. Returns and Right of Withdrawal

5.1 In compliance with EU consumer protection laws, you have the right to withdraw from your purchase within 14 days of receiving your order. The product must be unused, undamaged, and in its original packaging.

5.2 To initiate a return, you need to contact customer service. If using a prepaid return label provided by Bitcoin Artwear, a return fee will be deducted from your refund. Refunds will be processed within 14 business days of receiving the returned product.

5.3 Certain items, such as hygiene products with broken seals or personalized items, are non-returnable. These exceptions will be clearly stated during purchase.

5.4 If you return all items from an order (full return), we will refund the total amount, including any standard shipping costs paid during checkout. For partial returns, shipping fees will not be refunded unless the returned item incurred additional mandatory handling fees.

6. Gift Cards and Store Credit

6.1 Bitcoin Artwear gift cards are valid for 24 months from the date of purchase and can be used as a payment method on the Website. If the total value is not used in one transaction, the remaining balance can be used for future purchases within the validity period.

6.2 Store credit issued by Bitcoin Artwear is valid for 24 months and follows the same terms as gift cards.

7. Promotions and Discount Codes

7.1 Promotional offers, discount codes, and gifts are subject to specific conditions outlined at the time of the promotion. These offers cannot be combined unless explicitly stated.

7.2 If returning a product results in disqualification from a promotion or discount, we reserve the right to deduct the value of any associated gift or discount from your refund.

8. Complaints and Product Issues

8.1 If a product is defective or not as described, you have the right to make a complaint under applicable consumer protection laws. Contact customer service for assistance.

8.2 Complaints should be made promptly after discovering the issue. Bitcoin Artwear reserves the right to reject complaints resulting from misuse, washing or normal wear and tear.

8.3 When a returned product is confirmed as defective, we will reimburse you in accordance with applicable laws. If the complaint is deemed unjustified, we may charge a fee to cover return shipping costs.

9. Uncollected Packages

9.1 Customers are responsible for collecting or accepting deliveries. If a package is returned to us due to non-collection, we reserve the right to charge a fee of 25 EUR to cover the costs of shipping and handling.

10. Fair Use Policy

10.1 To shop with Bitcoin Artwear, customers must:

  • Avoid fraudulent activities or any behavior that violates applicable laws.

  • Provide accurate personal information during the purchase process.

  • Avoid exerting undue pressure or using threatening language when interacting with our customer service team.

  • Intend to retain the products they order. This does not affect your statutory right of withdrawal.

10.2 Examples of behavior that violate our Fair Use Policy include:

  • Attempting to commit fraud during returns, such as switching labels or claiming a product was lost.

  • Purchasing items under false pretenses, such as for resale purposes.

  • Using products for commercial purposes and returning them as if purchased for personal use.

  • Abusing promotional offers or discount codes.

  • Engaging in excessive or abnormal buying and returning practices.

10.3 Bitcoin Artwear reserves the right to refuse an order if we identify violations of our Fair Use Policy. If your order is declined, you will be notified via the email address provided during checkout.

10.4 Decisions to decline orders are based on non-discriminatory criteria. Customers may contact us to request a review of such decisions.

11. Liability and Force Majeure

11.1 Bitcoin Artwear is liable for damages caused by errors or delays in accordance with applicable consumer laws. However, we are not responsible for indirect damages or issues resulting from unforeseen circumstances, such as natural disasters or pandemics, beyond our control.

12. Governing Law

12.1 These Terms are governed by Danish law and applicable EU consumer protection regulations. These Terms apply to all customers and destinations around the world. In the event of a dispute, you may seek resolution through your local consumer protection agency or the EU Online Dispute Resolution platform.
